Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Equity Procurement Group LLC, doing business as Homevisory ("Homevisory," "we," "us," or "our"). By accessing or using our website at homevisory.com, our web application at app.homevisory.com, or any related services (collectively, the "Service"), you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not access or use the Service.
2. Description of Service
Homevisory is a home maintenance management service that provides:
- Personalized maintenance schedules — tailored to your home type, location, climate zone, and installed systems
- Maintenance reminders — timely notifications via SMS or email when tasks are coming due
- Step-by-step DIY guides — instructions, videos, and part identification for common home maintenance tasks
- Professional service coordination — the ability to request a qualified professional to handle tasks you prefer not to do yourself
Homevisory is a guidance and coordination service. We do not perform home maintenance work directly. Maintenance guides are general in nature and may not account for every home's unique conditions. Always exercise appropriate caution and consult a qualified professional when in doubt.
3. User Accounts
To use the Service, you must create an account. By creating an account, you represent and warrant that:
- You are at least 18 years old (or the age of majority in your jurisdiction)
- The information you provide is accurate, complete, and current
- You will keep your account credentials secure and not share them with others
- You will promptly notify us of any unauthorized access to your account
You are responsible for all activity that occurs under your account. Each account is intended for a single household. We reserve the right to suspend or terminate accounts that we reasonably believe are being shared or misused.
4. Subscription and Payment
Homevisory is a paid subscription service.
- Price: $19 per month
- Billing cycle: Your subscription renews automatically on a monthly basis on the anniversary of your initial payment date
- Payment method: Payments are processed securely through Stripe. We accept major credit and debit cards
- Price changes: We may change our subscription price with at least 30 days' notice. The new price will apply at your next billing cycle after the notice period
By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel. If a payment fails, we will notify you and may suspend your access to the Service until the payment issue is resolved.
5. Money-Back Guarantee
We offer a 30-day money-back guarantee for new subscribers. If you are not satisfied with the Service within the first 30 days after your initial payment, you may request a full refund by contacting us at support@homevisory.com.
After the 30-day period, subscription payments are non-refundable. You may cancel your subscription at any time to prevent future charges (see Section 6).
6. Cancellation
You may cancel your subscription at any time through your account settings or the Stripe billing portal. Upon cancellation:
- Your subscription will remain active until the end of your current billing period
- You will not be charged for the next billing period
- Your account data (home profile, maintenance history) will be retained for 30 days after your subscription ends, after which it may be deleted
We do not offer partial refunds for unused portions of a billing period, except as provided under the Money-Back Guarantee (Section 5).
7. SMS / Text Message Communications
During account setup, you may opt in to receive maintenance reminders and service updates via SMS (text messages). By opting in, you agree to the following:
- Message types: Maintenance reminders, service updates, and account notifications
- Frequency: Up to 2 maintenance reminder messages per week, plus service-related messages as needed
- Costs: Message and data rates may apply. Homevisory does not charge additional fees for SMS
- Opt-out: Reply STOP to any message or switch to email in your account settings. We will send one confirmation message after you opt out
- Help: Reply HELP for support information, or email support@homevisory.com
SMS notifications are optional. You may choose email-only notifications at any time. For full details on how we handle your phone number and SMS data, see our Privacy Policy.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to any part of the Service, other accounts, or systems
- Interfere with, disrupt, or overburden the Service or its infrastructure
- Upload or transmit malicious code, viruses, or harmful content
- Scrape, crawl, or use automated means to extract data from the Service
- Impersonate another person or entity
- Resell, redistribute, or sublicense access to the Service
- Use the Service to send unsolicited communications
9. Intellectual Property
The Service, including its content, features, design, text, graphics, logos, and software, is owned by Homevisory and protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial home maintenance purposes, subject to these Terms.
You may not copy, modify, distribute, sell, or create derivative works based on the Service or its content without our prior written consent.
10. Third-Party Services
The Service integrates with and relies on third-party services, including:
- Stripe — for payment processing, subject to Stripe's Terms of Service
- Twilio — for SMS delivery, subject to Twilio's Terms of Service
When you request professional service coordination, we may connect you with third-party service providers. Homevisory is not responsible for the quality, timeliness, or outcome of work performed by third-party service providers. Any agreement for services is between you and the service provider.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Without limiting the foregoing:
- Maintenance guides and schedules are general recommendations. They may not account for your home's specific conditions, local building codes, or manufacturer requirements. Always consult a qualified professional for work that involves safety, structural, electrical, or plumbing systems.
- We do not guarantee the availability, accuracy, or completeness of the Service at all times.
- We do not guarantee the quality, reliability, or availability of third-party service providers.
- Scheduling recommendations are based on general industry guidelines and may not be optimal for every situation.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEVISORY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or business opportunities
- Property damage resulting from following maintenance guides
- Personal injury resulting from DIY maintenance activities
- Costs arising from work performed by third-party service providers
- Service interruptions or data loss
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO HOMEVISORY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Homevisory and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or the rights of any third party
- Any content or information you submit through the Service
14. Dispute Resolution and Arbitration
Informal resolution first. Before filing any formal proceeding, you agree to contact us at support@homevisory.com and attempt to resolve any dispute informally for at least 30 days.
Binding arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Orange County, Florida, unless you and Homevisory agree to a different location or to conduct the proceeding by phone or video conference.
Small claims exception. Either party may bring an individual action in small claims court in Orange County, Florida, if the claim qualifies.
Arbitration fees. If your claim is for less than $10,000, Homevisory will pay all arbitration filing, administration, and arbitrator fees. For claims above $10,000, fees will be allocated according to AAA rules.
15. Class Action Waiver
YOU AND HOMEVISORY AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Unless both you and Homevisory agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not preside over any form of a representative or class proceeding.
If a court or arbitrator determines that this class action waiver is unenforceable, the arbitration agreement in Section 14 shall be void in its entirety, and any resulting dispute shall be resolved in court as set forth in Section 17.
16. Termination
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe that:
- You have violated these Terms
- Your conduct may harm Homevisory, other users, or third parties
- Your account has been used for fraudulent or unauthorized purposes
Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 9, 11–15, and 17.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Orange County, Florida.
18. Force Majeure
Homevisory shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, internet outages, third-party service failures, or cyber attacks.
19. General Provisions
- Entire agreement: These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Homevisory regarding the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
- Notices: We may provide notices to you via email to the address associated with your account, or by posting a notice on the Service.
20. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Notify you via email or a prominent notice on the Service at least 30 days before the changes take effect
Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.
